Local Approvals Policy Review

Council is reviewing its Local Approvals Policy (LAP). The LAP applies to applications for approvals for certain activities including activities on community land, footpath dining, street stalls, water supply, installation of sewerage management systems, drainage, installation of caravans/manufactured homes and mobile food vans in the Shoalhaven Local Government Area (LGA). 

Section 68 of the Local Government Act 1993 (LG Act) specifies that certain activities can only be carried out with the approval of Council under the provisions of the LG Act, except in the case of local or legislative exemptions. The LAP assists Council in meeting its obligations relating to local approvals. 

A local approval differs from a development consent issued under the Environmental Planning and Assessment Act 1979. A local approval may be required in isolation (e.g. where a land use/activity is exempt or permitted without consent) or in addition to development consent application.  

In addition to a range of minor amendments, the draft LAP seeks to insert new criteria that enables the installation of a moveable dwelling or associated structure on land to accommodate a person who has been displaced as a result of a natural disaster.

The draft Local Approvals Policy is on public exhibition on Council’s Documents on Exhibition webpage for community comment from Wednesday 25 May until Friday 24 June.

Submissions close at 5pm Friday 8 July.
