The new Shoalhaven Local Environmental Plan (LEP) 2014 came into operation on 22 April 2014, and is largely a ‘best fit’ transfer from the previous LEP into the NSW Government's Standard Instrument Local Environmental Plan format.
Leading up to, and following the commencement of Shoalhaven LEP 2014, a number of required ‘housekeeping’ changes were identified to improve the Plan’s operation and accuracy.
Council also continuously reviews its LEP to ensure it aligns with Council’s strategic objectives, is operationally effective and delivers positive outcomes for the community.
Council has been undertaking a series of housekeeping updates to the LEP, the latest and most significant of these is Amendment No. 11 (Stage 3 Housekeeping Amendment) which was finalised and became effective on Friday 19 August 2016.
The amendment includes a broad range of instrument and mapping changes to improve the operation and accuracy of the Shoalhaven LEP 2014. Some of the more significant changes and adjustments include a rural boundary adjustments Clause, clarifying when dual occupancy can be considered in medium density zones, making certain ‘community events’ exempt development, inserting provisions related to bonus building heights within the Huskisson town centre and a range of other mapping/instrument improvements
An explanatory statement outlining the changes made through this Amendment is currently available on Council’s website www.shoalhaven.nsw.gov.au. The legal version of the Shoalhaven LEP 2014 on the NSW Legislation Website and the online LEP mapping systems on Council’s website will be updated in due course.
